Terms and Conditions of Sale – Shop World Market

These Terms and Conditions govern consumer purchases made through the Shop World Market website.

Online sales of tangible goods are generally treated, for Italian VAT purposes, as indirect electronic commerce and are comparable to mail-order sales. Where the applicable conditions are met, such sales are not subject to the obligation to issue an invoice unless requested by the customer no later than the time of purchase, nor to the ordinary obligation to issue a fiscal receipt, without prejudice to any applicable accounting, tax and reporting requirements.

Before submitting an order, the customer must read these Terms, the Privacy Policy, the Cookie Policy and the information displayed on the relevant product and checkout pages.

2. Definitions

Seller: Naturamica Di Monasterolo S.r.l, operating through the Shop World Market trading name.

Customer or Consumer: a natural person purchasing goods for purposes outside their business, commercial, craft or professional activity.

Website: the Shop World Market website through which the products are advertised and orders are collected.

Product: any tangible movable item offered for sale through the Website.

Distance contract: a sales contract concluded between the Seller and the Consumer without their simultaneous physical presence, through the Website or another permitted means of distance communication.


3. Scope of Application

These Terms apply to purchases made by Consumers through Shop World Market. Customers purchasing for business or professional purposes should contact the Seller before placing an order, as different contractual and tax conditions may apply.

The Customer declares that the information provided during the ordering process is complete, accurate and truthful and that they are legally capable of entering into the contract.


4. Product Information

The main characteristics, price and available options of each Product are shown on the relevant sales page.

Images and videos are provided to represent the Product as accurately as reasonably possible. Minor differences in colour, packaging, accessories or appearance may occur because of screen settings, production updates or packaging changes, provided that they do not alter the essential characteristics or conformity of the Product.

Any promotional claim, discount, limited availability statement or comparison must reflect the offer and Product actually available at the time of purchase.


5. Prices

Product prices are displayed in the currency indicated on the Website and include VAT where applicable, unless clearly stated otherwise.

Delivery charges, cash-on-delivery charges and any other mandatory costs are displayed before the Customer submits the order.

The total amount shown in the final order summary is the amount payable by the Customer, except in the event of an obvious and recognisable technical pricing error.


6. Ordering Process and Conclusion of the Contract

To place an order, the Customer must:

  1. select the Product and any available options;
  2. enter accurate contact and delivery information;
  3. review the Product, quantity, price and delivery charges;
  4. accept these Terms where required;
  5. submit the order using the clearly labelled order button.

Before submitting the order, the Customer can review and correct the information entered.

Receipt of an order does not automatically constitute acceptance where additional verification is required. The Seller may contact the Customer by telephone, SMS, WhatsApp or email to verify the order, correct incomplete information or arrange delivery.

The contract is concluded when the Customer receives confirmation that the order has been accepted, or when the Product is dispatched, depending on the ordering process used by the Website.

The Seller may refuse or cancel an order in cases including:

  • incorrect or incomplete customer information;
  • suspected fraud, abuse or repeated unjustified refusal of deliveries;
  • Product unavailability;
  • an obvious price or technical error;
  • delivery to an unsupported location;
  • other objective reasons preventing lawful performance.

If payment has already been collected, any amount due will be refunded without undue delay.


7. Payment Methods

The payment methods actually available are shown during checkout and may include:

  • cash on delivery;
  • credit or debit card;
  • PayPal;
  • bank transfer;
  • other payment methods clearly displayed on the Website.

The Customer must use a valid payment method and is responsible for ensuring that they are authorised to use it.

Cash on Delivery

Where cash on delivery is available, the Customer must pay the total amount stated in the order confirmation directly to the courier according to the payment methods accepted by the courier.

The Customer must ensure that an authorised person is available at the delivery address and that payment can be completed at delivery.


8. Invoices and Tax Documents

Where an invoice is required, the Customer must request it during the ordering process and provide all necessary and accurate billing information, including any applicable tax code, VAT number, business name or certified electronic invoicing details.

Requests made after completion of the transaction may not be accepted where prohibited by applicable tax rules.


9. Shipping and Delivery

Products are delivered by couriers or logistics providers selected by the Seller.

Any delivery times displayed on the Website are estimates unless a specific binding date has been expressly agreed. The estimated delivery period starts after order acceptance and any necessary verification.

A typical delivery estimate may be stated as 24–48 working hours from dispatch, but actual delivery times may vary depending on the destination, courier, weekends, public holidays, stock availability and events outside the Seller’s reasonable control.

Unless otherwise agreed, the Seller will deliver the goods without undue delay and no later than 30 days after conclusion of the contract, as required by applicable consumer law.

The Customer must provide a complete and accessible delivery address and a valid telephone number. Additional costs caused by incorrect information, unjustified refusal or repeated failed delivery attempts may be charged only where permitted by law and clearly communicated.


10. Shipping Costs and Customs Charges

Shipping charges and any cash-on-delivery fees are displayed before the order is submitted.

For deliveries outside the European Union, customs duties, import taxes and local clearance costs may apply. Unless expressly stated otherwise, these charges are borne by the Customer and are not included in the Product price.


11. Transfer of Risk

For consumer purchases, the risk of accidental loss or damage passes to the Customer when the Customer, or a third party appointed by the Customer other than the courier, physically receives the Product.

If the Customer independently appoints a courier not proposed by the Seller, the risk may pass when the goods are handed over to that courier, in accordance with applicable law.


12. Product Availability

Product availability may change between the time the sales page is viewed and the time the order is processed.

If a Product becomes unavailable after the order has been submitted, the Seller will inform the Customer without undue delay and may offer:

  • a suitable replacement, subject to the Customer’s approval;
  • a new estimated delivery date;
  • cancellation of the unavailable Product;
  • a full refund of any amount already paid for that Product.

The Customer is never required to accept a replacement Product.


13. Inspection at Delivery

The Customer should check the package at delivery and, where possible, report visible damage, missing packages or signs of tampering to the courier.

Accepting a visibly damaged package without reservation does not remove mandatory consumer rights, but promptly documenting the condition of the parcel can assist with the handling of a complaint.

The Customer should retain the packaging and take clear photographs where a Product arrives damaged, incomplete or different from the order.


14. Legal Guarantee of Conformity

Products sold to Consumers are covered by the legal guarantee of conformity provided by Articles 128 and following of Italian Legislative Decree No. 206/2005.

For new goods, the Seller is responsible for defects of conformity that become apparent within two years from delivery, subject to the rules and limitation periods established by applicable law.

A Product may lack conformity when, for example, it:

  • does not correspond to the agreed description or specifications;
  • is not suitable for its ordinary or agreed purpose;
  • does not possess the quality, durability or safety reasonably expected;
  • is supplied without agreed accessories or instructions;
  • does not match the sample, model or advertising statements relied upon.

In the event of a lack of conformity, the Consumer may be entitled, under the applicable legal conditions, to repair or replacement without charge. Where those remedies are impossible, disproportionate, not completed within a reasonable time or cause significant inconvenience, the Consumer may be entitled to an appropriate price reduction or termination of the contract.

The legal guarantee is separate from any optional commercial warranty offered by the manufacturer or Seller and cannot be excluded or reduced by these Terms.

15. Right of Withdrawal

Subject to the exceptions established by law, the Consumer has the right to withdraw from an online sales contract without giving any reason within 14 days.

For the purchase of a single Product, the withdrawal period expires 14 days after the day on which the Consumer, or a third party appointed by the Consumer other than the courier, acquires physical possession of the Product.

For multiple Products ordered together and delivered separately, the period normally starts when the last Product is received.

How to Exercise the Right of Withdrawal

Before the withdrawal period expires, the Consumer must send an unequivocal statement communicating the decision to withdraw to:

The Consumer may use the model withdrawal form made available on the Website, but use of that form is not mandatory.

The Consumer should provide the order number, name, contact information, Product concerned and date of receipt so that the request can be handled efficiently.

Returning the Product

After communicating withdrawal, the Consumer must return or hand over the Product without undue delay and in any event within 14 days from the date on which the withdrawal was communicated.

Unless the Seller has agreed to bear them or failed to provide the required information, the direct cost of returning the Product is borne by the Consumer.

The Consumer is responsible only for any reduction in the Product’s value resulting from handling beyond what is necessary to establish its nature, characteristics and functioning.

Original packaging should be used where reasonably possible to protect the Product during return. The absence or opening of the original packaging does not automatically remove the statutory right of withdrawal, although the Consumer remains responsible for avoidable damage or loss of value.

Refund After Withdrawal

The Seller will refund all payments received for the withdrawn purchase, including the cost of the least expensive standard delivery method offered, without undue delay and no later than 14 days after being informed of the Consumer’s decision to withdraw.

Additional delivery costs resulting from the Consumer’s choice of a more expensive delivery method are not refundable.

The Seller may withhold the refund until the returned goods are received or until the Consumer provides evidence that the goods have been sent back, whichever occurs first.

The refund will normally be made using the same payment method used for the original transaction, unless otherwise expressly agreed and provided that the Consumer does not incur additional fees.

For cash-on-delivery orders, the Consumer may be asked to provide bank or other payment details necessary to complete the refund securely.


16. Exceptions to the Right of Withdrawal

The right of withdrawal does not apply in the cases provided by Article 59 of the Italian Consumer Code, which may include:

  • goods made to the Consumer’s specifications or clearly personalised;
  • goods liable to deteriorate or expire rapidly;
  • sealed goods unsuitable for return for health-protection or hygiene reasons once unsealed;
  • goods that, after delivery, are inseparably mixed with other items;
  • sealed audio, video or software products once unsealed, where applicable;
  • other cases expressly excluded by applicable law.

Any applicable exception will be clearly communicated before the order is submitted.


17. Voluntary Product Exchanges

The Seller may offer a voluntary exchange service in addition to the statutory rights described above.

Where offered, the applicable conditions, deadlines, availability and return costs will be communicated to the Customer. A voluntary exchange policy does not limit the legal guarantee or the right of withdrawal.

The Seller may request photographs or other reasonable information to verify the Product’s condition and arrange the exchange.


18. Customer Obligations

The Customer agrees to:

  • provide complete, accurate and truthful order information;
  • pay the agreed price using the selected payment method;
  • ensure that delivery can be completed at the address provided;
  • use the Product according to its instructions and intended purpose;
  • retain the order confirmation and relevant purchase documents;
  • avoid submitting fraudulent, abusive or speculative orders.

19. Seller Liability

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including mandatory consumer rights and liability for fraud, wilful misconduct, gross negligence, death or personal injury where applicable.

Within the limits permitted by law, the Seller is not responsible for failure or delay caused by events outside its reasonable control, including natural disasters, transport interruptions, strikes, public authority measures, telecommunications failures or other force-majeure events.

Where such an event affects performance, the Seller will inform the Customer where reasonably possible and take appropriate steps to limit the consequences. The Customer retains all mandatory remedies available under consumer law.

The Seller is not responsible for damage caused by improper use, unauthorised modification, failure to follow instructions or ordinary wear and tear, without prejudice to the legal guarantee of conformity.


20. Intellectual Property

Website content, including text, graphics, logos, images, videos, page layouts and software, may be protected by intellectual-property rights.

Users may not reproduce, distribute, modify or commercially exploit such content without the permission of the relevant rights holder, except where permitted by law.


21. Personal Data

Personal data is processed in accordance with Regulation (EU) 2016/679, the Italian Privacy Code and the information provided in the Shop World Market Privacy Policy.

22. Customer Service and Complaints

The Customer should include the order number and a clear description of the request. Where relevant, photographs or videos may be requested to help assess damage, defects or incorrect delivery.


23. Alternative Dispute Resolution

Consumers may use any applicable out-of-court dispute-resolution body recognised under Italian or European consumer law.

Information about any specific ADR body to which the Seller is committed or legally required to refer disputes will be provided where applicable.


24. Governing Law and Competent Court

These Terms and the sales contracts governed by them are subject to Italian law, without prejudice to any mandatory protection granted to a Consumer by the law of the country in which the Consumer habitually resides.

For disputes involving a Consumer, jurisdiction lies with the court of the Consumer’s place of residence or domicile where required by mandatory consumer law.

For customers who do not qualify as Consumers, the competent court will be determined in accordance with the applicable law and any valid contractual agreement.


25. Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.


26. Changes to These Terms

The Seller may update these Terms to reflect legal, commercial, technical or organisational changes.

The version applicable to an order is the version available to the Customer when that order is submitted. Later changes apply only to future orders unless required by law.

Important: the contact details, payment methods, delivery times, return address, fees and services stated in these Terms must correspond to those actually offered by Shop World Market.
